Terms of Service

Welcome to Heretoo (the "App"), operated by Movanta ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the App. By creating an account or using the App, you agree to be bound by these Terms.

If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. By creating an account, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into this agreement.

If you are using the App on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.

2. Account Registration

To use the App, you must create an account. You agree to:

  • Provide accurate, current, and complete information (real name, valid email, and valid international phone number).
  • Maintain and promptly update your account information.
  • Keep your password confidential and not share your credentials with anyone.
  • Take responsibility for all activity that occurs under your account.

You may not impersonate another person, create multiple accounts to circumvent restrictions, or use someone else's account without permission.

We may suspend or terminate accounts that violate these Terms.

3. How the App Works

The App lets you:

  • Declare upcoming trips (city, dates, confirmation level, and optional private notes).
  • Add friends by email or phone, or by accepting their friend requests.
  • See when your declared trips overlap with your friends' declared trips, based on geographic proximity and overlapping dates.
  • Receive notifications about these overlaps.
  • Contact friends directly through WhatsApp or SMS to coordinate meetings.

The App is a tool for coordination — we do not facilitate, validate, or take responsibility for any in-person meeting, transaction, or relationship that may result from using the App.

4. User Content

You retain ownership of the information you submit ("User Content") — your trips, notes, friend list, and profile data.

By submitting User Content, you grant us a limited, non-exclusive, royalty-free license to store, process, and display that content only as necessary to operate the App for you and the friends you have accepted.

You are responsible for the legality and accuracy of your User Content.

You agree not to:

  • Submit false, misleading, fraudulent, or defamatory content.
  • Use the App to harass, stalk, threaten, or harm any other person.
  • Reverse-engineer, scrape, or attempt to extract data about other users.
  • Use automated means (bots, scripts, scrapers) to interact with the App.
  • Attempt to circumvent any security or rate-limiting measures.
  • Use the App for illegal purposes or in violation of any applicable law.
  • Resell, sublicense, or commercially exploit the App or its data.

We may remove User Content or terminate accounts that violate these rules without prior notice.

5. Friend Network and Privacy Responsibilities

You only become visible to other users after they accept your friend request or you accept theirs. Until then, the only data shared is what's necessary to send the invitation (typically an email address).

You are responsible for who you accept as a friend. We do not verify identities or relationships.

If a friend's behavior makes you uncomfortable, you can remove them at any time through the App — this immediately stops sharing your trips with them and removes any pending matches.

6. Push Notifications

By enabling notifications, you authorize us to send you push notifications related to:

  • Trip overlaps detected with your friends.
  • Account-related events you may need to know about.

You can disable notifications at any time in iOS Settings or by deleting the App.

We will not send marketing or promotional push notifications.

7. Intellectual Property

The App, including its design, code, brand, and content provided by us, is the property of Movanta and its licensors. Nothing in these Terms grants you any right to use our trademarks, logos, or other proprietary materials without our written permission.

8. Third-Party Services

The App relies on third-party services to function (Apple Push Notification service, geocoding APIs, our backend hosting). Their availability and policies are outside our control. We are not responsible for outages or issues caused by third parties.

When you tap a "WhatsApp" or "SMS" button inside a match, you are leaving the App and entering services operated by third parties (Meta and your phone carrier). Their terms and privacy policies apply.

9. Service Availability

We do our best to keep the App running smoothly, but we do not guarantee uninterrupted availability. We may modify, suspend, or discontinue any part of the App at any time, with or without notice.

We may also push automatic updates to the App. By using the App, you consent to receiving these updates.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The App will be error-free or uninterrupted.
  • Matches will always be accurate or complete.
  • Notifications will always be delivered on time.
  • The information shared by other users is accurate.

You use the App at your own risk. Decisions to meet other users in person are entirely yours.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Movanta, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE APP, INCLUDING DAMAGES FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR DAMAGES RESULTING FROM IN-PERSON INTERACTIONS WITH OTHER USERS.

OUR TOTAL LIABILITY TO YOU UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS (CURRENTLY $0, AS THE APP IS FREE), OR (B) USD $50.

Some jurisdictions do not allow these limitations, so they may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless Movanta and its officers, directors, employees, and agents from any claim, damage, liability, or expense (including reasonable attorneys' fees) arising from:

  • Your use of the App.
  • Your violation of these Terms.
  • Your violation of any law or third-party right (including privacy or intellectual property rights).
  • Any in-person interaction you have with another user.

13. Termination

You may terminate your account at any time by using Settings → Delete account inside the App. Upon termination, all your data is permanently erased.

We may suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms.

Sections of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will continue to apply after termination.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the App will be resolved in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.

If you are a consumer protected by mandatory laws of your country of residence (such as in the European Union or Brazil), nothing in these Terms limits your right to bring proceedings in your local courts under your local consumer-protection law.

15. Changes to These Terms

We may update these Terms occasionally. Material changes will be communicated through the App or by email at least 14 days before they take effect. Continued use of the App after the effective date means you accept the updated Terms.

If you don't agree to changes, you can delete your account before they take effect.

16. Miscellaneous

  • Severability: If any provision of these Terms is found unenforceable, the rest will remain in effect.
  • Entire agreement: These Terms (plus our Privacy Policy) are the entire agreement between you and us regarding the App.
  • No waiver: Our failure to enforce any right does not waive that right.
  • Assignment: You may not assign or transfer your rights under these Terms. We may.
